2. The affiant’s signature (the person or people who will be signing the power of attorney) must be a wet ink original. Meaning the signature (s) on the power of attorney that the Texas notary public witnessed cannot be a photocopy, electronic, or automated autopen type signature. You must physically be in the presence of a Texas notary public when you sign the power of attorney.
3. The notary’s signature on your power of attorney must be a wet ink original. Meaning the signature on the power of attorney that the Texas notary public made cannot be a photocopy, electronic, e-notary, online notary, or remote notary signature made. The power of attorney must be notarized and signed physically in person with you.
4. The notary public you choose to hire to watch you sign your power of attorney document must be a Texas notary public. You cannot use a notary from any other state, province, or country. Only a Texas notary public to notarize your power of attorney if you want to receive an apostille or authentication certificate for the State of Texas.
5. You must submit your original power of attorney document it cannot be a photocopy or electronic copy of your POA document.
